Alternate Dispute Resolution (the fancy name for such processes as mediation or arbitration) has become an increasingly popular alternative to litigation as a means to resolve disputes.  Mediation is especially popular since it is relatively inexpensive and is non-binding unless the parties reach an agreed settlement at the mediation.  Cases involving auto accidents, business disputes, or conflicts between heirs of an estate are examples of disputes that often get resolved through mediation.
